Web sites not liable for posts by others

The California Supreme Court ruled yesterday that Web sites that publish inflammatory information written by other parties cannot be sued for libel. The court based the decision mostly on the Communications Decency Act of 1996 which provides broad immunity from defamation lawsuits for people who publish information on the Internet that was gathered from another source. Interestingly, Amazon, America Online, eBay, Google, Yahoo, and Microsoft were very happy with the decision and took the defendant’s side out of concern that a ruling against her would expose them to liability. This is definitely a good decision, even if it supports offensive material. Freedom of speech should come first.
